As a notary in New York State, your commission is in your county of residence. Accordingly, it is your county clerk who would certify your official character as a commissioned notary public. You may ask what circumstance would require a certificate of Official Character. Well, certain clients may require certification and authentication. This is because a given document may be delivered into evidence. In our current society, with a litigious mentality, the ability to have a document read into evidence can be vital. So, assume you live in Columbia County. Besides Columbia County you foresee doing notarial acts in Cortland County. Given this scenario, you would have to record your autograph in Cortland County. You would then file your certificate of official character in Cortland County (Or any number of counties, for that matter). Therefore, you are registering your notary commission in an additional county. Fees You can purchase an Office Character Card. You purchase it from the county clerk in the county where you were certified. However, the fee for issuing your certificate is $5. There is an additional cost of $10 to register your commission in a given county. Other Facts The signature of the county clerk does not have to be original. It photographed, stamped, printed, engraved, or even faxed on an authentication. Thus, if you are certified in Cayuga County, and a person or entity in Albany County needed to verify your signature (Notary Authentication), they would have to travel to the county clerk in Cayuga County. Thus, you can make it simpler for your constituents by recording a Certificate of Official Character in Albany County. But, the key here is: printed, faxed, etc. Your certificate expires with your notary commission, which means you need a new one every 4 years. When you obtain your Certificate of Official Character, you can tender it to the county clerk (In the situation just described, county of Albany). The same applies for any other county in the State.
